An action to “Quiet Title” is an equitable action in court to determine the ownership rights of disputing parties when there are adverse claims to the property (Real Estate) in order to establish a party's title to the property against anyone and everyone, and thereby "quiet" any claims or challenges to the title in question. Such an action usually arises when there is some question about clear title to the property, commonly called a “Cloud on Title” to the property. Actions to Quiet Title usually arise when there are some allegations by disputing parties asserting and claiming adverse interests in the subject property, when there is a defect in the recording of prior deeds in the chain of title, when there are disputed easements, encroachments, and in cases of fraud or breach of contract. The ultimate outcome of the proceeding will determine who is the lawful owner of the disputed property and title will be “Quieted”.
